These Terms of Service ("Terms") govern your use of the KM Commerce website at kmcommerce.au and any purchases you make through us. By using the site or placing an order, you agree to these Terms.
KM Commerce is a trading entity operated by P.N Kounas & P Melasecca, ABN 92 529 375 010, with a registered address at 11/488 Bourke Street, Melbourne VIC 3000, Australia.
1. Eligibility
You must be at least 18 years old, or have permission from a parent or guardian, to place an order. By submitting an order you confirm that the information you provide is accurate and that you are authorised to use the payment method.
2. Products and pricing
All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable. Prices may change without notice, but changes will not affect orders already accepted by us.
We make reasonable efforts to ensure product descriptions and images are accurate, but minor variations between the product photograph and the item delivered may occur. Colours may also appear differently on different screens.
3. Orders and acceptance
When you place an order, you make an offer to buy the products at the listed price. Your order is accepted by us when we send a confirmation email. We reserve the right to reject any order, including for reasons such as stock unavailability, pricing errors, suspected fraud, or where shipping is not available to your address.
4. Payment
Payment is required in full at the time of order. We accept the payment methods displayed at checkout. Payments are processed by our payment provider; we do not store your full card details on our own systems.
5. Shipping and delivery
Many of our products are shipped from our overseas supply partners. Estimated delivery times are typically 7 to 21 business days for Australian addresses, depending on the product and origin. See our Shipping Policy for full details.
We are not responsible for delays caused by customs clearance, postal services, or events outside our reasonable control. Risk in the goods passes to you on delivery.
6. Returns and refunds
Your rights under the Australian Consumer Law (ACL) are not affected by these Terms. In addition to your statutory rights, we offer change-of-mind returns under the conditions set out in our Returns & Refunds Policy.
7. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
8. Intellectual property
All content on the website, including text, images, logos, and design, is owned by or licensed to KM Commerce. You may not copy, reproduce, distribute, or create derivative works without our written permission, except for personal, non-commercial use.
9. Limitation of liability
To the extent permitted by law, our total liability to you for any loss or damage arising from the products or this website is limited to the amount you paid for the product. Nothing in these Terms limits or excludes any rights or remedies you have under the Australian Consumer Law that cannot be lawfully excluded.

11. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on this page. Continued use of the website after a change constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
